Answers to Frequently Asked Questions

  • Q.  When should an employee complete a Family Medical Leave request?

    A.  Any time an employee is out for more than five days due to their own serious illness, for a family member’s serious illness, for the birth of a child, or for placement of a child with the employee for adoption or foster care.   If an employee knows that they will be going on leave for a foreseen situation as surgery or maternity, FMLA paperwork should be completed 30 days in advance.

    Q.  What does FMLA do?

    A.  FMLA secures a qualified employee’s benefits and position for 12 weeks (60 workday) period.  The Alaska Family Leave Act (AFLA) provides an eligible employee of 18 weeks of unpaid leave in a 24-month period.  Please note if employee qualifies under both FMLA and AFLA, the leave will run concurrent.

    Q.  How is FMLA counted?

    A.  FMLA is counted from the first day an employee is out on leave counting scheduled workdays. FMLA is counted concurrently with any leave the employee may be using to keep them in paid status. For example, if an employee is using accrued sick leave while on Family Medical Leave; both FMLA and sick leave will run concurrently.
